Ослабление этого пятнадцатилетнего междуцарствия Особого 301 процесса также прослеживается в лидерстве USTR по текущему раунду выбора площадки принудительного применения прав IP. Признаки открытости агентства приходят в тот момент, когда некоторые из основных достижений USTR были заложены в ACTA. Конечная юрисдикция ACTA является неясной на данный момент и может оставаться таковой долгое время после того, как соглашение будет ратифицировано — если оно будет ратифицировано. Однако ACTA, по-видимому, как минимум, подорвёт превосходство ВТО в принудительном применении и отбросит двусторонние и многосторонние режимы обратно в более тесную увязку, по крайней мере, временно. Особый 301 процесс вряд ли исчезнет в этом контексте. Скорее всего, он станет механизмом для оказания давления на другие страны, чтобы принять новый многосторонний режим, и в конечном итоге для новой политики ACTA +.
