6. Беззащитные защитники

1. Эта цитата часто приписывается Клэренсу Дэрроу, в дань памяти его прекрасной книге «Attorney for the damned», однако, как в случае многих других легенд, проверить, когда, где и была ли вообще она им произнесена, не представляется возможным.

2. Директивы о выборе меры наказания при сокращении срока тюремного заключения в случае признания подсудимым собственной вины действительно являются исключением из общего правила, согласно которому «для указания вины требуется дополнительная информация, помощь или юридический совет», что должно подходить к описанному сценарию. Вместе с тем в случае признания уже сам суд решает, принимать ли ему аргументы защиты или нет.
